Scheduling a forthcoming DASA (Defunct ASA) check ride, and it’s not funny.

CFI: Hi , Jim here… used to be at Castle ASA remember me?
Hey listen, I’ve got a student ready for a commercial check ride real soon.

DPE: Hi Jim, I’ve heard you guys were closed and Prince and Reny are in hot water…………..
so what about this check ride? Has he met all requirements and the paper work ready?

CFI: Yup. no problem there, he’s ready and I’ll have all paper work ready for you.
How about Saturday at Yandell Ranch OK?

DPE: Where?

CFI: you know the small private field about 7 miles west of town on 132…
we’ve got owner’s permission and everything.

DPE: why not at muni? Besides the runway is way too short over there and they even don’t have fuel.

CFI: we’ve been doing a lot of flying at private fields lately because feds and repo guys are snooping around for some reason, and we’d like to keep them off our tail, you know.

oh don’t worry about fuel, we call up Prince and Reny on cellphone and they deliver it right up,
normally they carry few 5 gallon cans in the car.

DPE: what? You guys been using auto gas? Do you have a STC for that?

CFI: Prince said we do, and I trust him.

DPE: Yah right!

CFI: Hey listen, Prince and Reny are just driving up, I’ve got to run, I’ll call you again later. Click….

DPE: Tche, tche! (shaking head)

I have the news where these students are going to get their admissions for their check ride

Thanks Mr. Bjoy aden for providing the names, IT SEEMS THEY ARE TALENTED AND CLEVER ENOUGH TO PROVE THE FAA AND THE IMMIGRATION TO LOOK LIKE A FOOL.

Two of the names (KAUSHIK & SHIVANI) were a fish trapper for Prince and Renny, they earned a lot by catching innocent students from India and elsewhere and made false promises even when the school was in the brink of extinction, they even said the student’s it was a summer vacation and they would receive a new laptop from the school when it reopens, and the third name (DEEPAK MAHALA) is a great and renowned person in ASA, an alcoholic and a drugs addict who was and is a hired mercenary for Prince and Renny to threaten the students from time to time. A few number of such cases are also registered against him in the Merced county. And about JIM I have no clue why is he still ******** Prince and Renny’s ***, probably he wants some multi hours so he even wants to triple his multi hours on the Dutchees as he was turned down from Cal Air for not meeting his multi requirements for an multi instructor post. They know it very well that with the current status they can complete their requirements but cannot go on with a check ride, so the next thing they will do is to get an I-20 of a school, get new TSA’s and complete their check ride. And probably they will seek a school which is far away from here, may be Arizona, Texas or elsewhere so that their records cannot be traced.

I have full support for the students of ASA who have suffered such heavy losses, and I am getting other people to help them but my sincere request will also be that all the students and the people who are in support should stand up and stop these kind of mean minded people to get away easily, they dont have any sympathy towards the suffered students, they only know their business, they can dance on their own ones graves for getting their work done. As per my information I have the news where these students are going to get their admissions for their check ride, and I will work seriously to see that I can update the concerned school regarding the matter so that they can not escape.

In Re: American School of Aviation

Dear Messrs Murray and Lehman:

In the FAA Aircraft Registry records, there appears to exist conflicting records that are likely to constitute a violation in compliance with the statutory requirement relating to civil aircraft registry in the US.

Synopsis:
American School of Aviation, Inc. is a California corporation with its president and other corporate officer(s) are not U.S. citizen.

Title 14 CFR Part 47 of the Federal Aviation Regulations (FAR) governs the requirement related to the civil aircraft registration in the US

Part 47.3 stipulates Registration required.
Part 47.5 defines Applicants.
Part 47.7 defines U.S. citizens and resident aliens with respect to civil aircraft registration.
Part 47.9 defines “Corporations not U.S. citizen”.
Part 47.9 (f) stipulates thrice annual report requirement by the registrant to the FAA.

Analysis:
All ASA aircraft except one (30 before 8/04/08 down to 11 as of 8/14/2008 ) are currently registered under FAR Part 47.7 and issued aircraft registration certificate bearing “Corporation” instead of its true and factual status of its corporate entity as “Foreign Corporation”. In the FAA AC Form 8050-1 Aircraft Registration Application, there is a specific box to be checked off for Non-citizen Corporation and provided along with “Certification” section for the applicant’s certification for a non-citizen corporation. If these sections were properly completed in the ASA aircraft registration application, all of its registration then should have been issued under Part 47.9 with the respective registration certificate bearing ”Foreign corporation”

Conclusion:
If ASA has made erroneous entry in its aircraft registration application and submitted to the FAA Aircraft Registry knowingly or not knowingly and obtained its registration certificate, then the ASA aircraft are not registered under Part 47.9 and not in compliance with Part 47.9(f) requirement. This ipso facto invalidates all of its registrations under FAR 47.41(a) ( 8 ) (ii) and requires ASA to surrender all of its invalidated registration certificate immediately in accordance with FAR 47.43 (b).

One of the school owners had publicly stated their school received 109 surveillance visits from your office in 2007, yet why this blatant aircraft registration violation eluded the filed inspectors scrutiny is beyond me.

There exists an ample evidence based on flight activities taking place recently at Hayward, Modesto and elsewhere to indicate the school is still operating under the guise of new satellite base after its 141 school certification has been long presumed to be suspended if not revoked already.

In view of the matter affecting the welfare and interests of all those victimized students as well as that of local aviation community, it would be most appropriate that your office offers a public announcement in connection with the ASA matter as soon as aircraft registration investigation is completed.

All eyes are on your prudent and swift enforcement action.

Only chance of recovery of the student’s fees from ASA is……………….

Hello ASA students,

First off, I’d like to express my sincere sympathy for those students stranded by the recent ASA fiasco and wish you all the early arrival of meaningful assistance to alleviate the current enduring hardship. I have no personal stake in this ordeal and neither lost nor gained anything from this occurrence. Nevertheless I can’t stop being indignant about both Prince and Reny of their incompetence and deceit whichever the characterization is appropriate that brought to cause a current plight onto those young aspiring Indian students.

In as much as I’d like to believe that Prince and Reny stashed away a sizable amount of cash somewhere as some still like to speculate or believe and therefore there’s some chance of recovery of their prepaid fees, it pains me to tell you all such chances to exist is literally infinitesimal if not nonexistent.

I know it’s easier said than done but give it a rest on a hope of recovery by a means of law suit. In the Breach of Contract case such as this, you will most likely prevail in the court and obtain a judgment. But think about it, what good is it that the judgment that can collect nothing from the defaulting party. A writ of execution issued from the court is just a useless paper of no value. Remember no one wins in a law suit except lawyers. (been there, done that, fought an airport use permit issue against a county ordinance in the US Federal Court and won the battle but lost the war in the end after consuming 3 years and $150K in legal fees, .a Pyrrhic victory indeed.

Judging from the reported size of operation,(110 students, 43 instructors, 40 aircraft) the monthly operating cost could be anywhere from $225k to $250k/mo. or more to keep that size of operation going. Remember ASA did not have $4.4 mil in a lump sum cash to start with. It’s an accumulative total revenue over the time they were in business. Unless they had an sufficient operating capital set aside which I doubt, their monthly operating expenses were entirely relied on one source; student fees. There’re good months with some surplus fund left and there’re some bad months with an insufficient amount of income even to cover the monthly overhead. It’s highly probable that ASA needed at minimum 4 to 5 new students to keep its doors open. All fees collected from the students were all spent long since and I bet they’re just scraping by from month to month with a hope of someday getting ahead with an arrival of new enrollment group consisting of substantial number of students. Unfortunately, that day never came and the KFA fallout was the last straw. And while they were still at it, the problems started to pile up one after another. It probably started with a minor student’s complain and then rapidly growing to many issues that eventually raised red flags and invited all kinds of government scrutinies from all directions FAA, County’s office, IRS, FTA (Calif. State Franchise Tax Board) and all. Despite less than honorable character references made about both Prince and Reny in many posts, I doubt they had planned this outcome from the beginning. It’s a case of pure incompetence and mismanagement. They had somehow managed to slip their foot in the door and pried open the business opportunity just in time to ride the surging tide of pilot shortages beginning to be faced by the Indian airlines.

Some of you already know about another flight school closure earlier this year which draws some parallels to the events at ASA in the order of far greater magnitude.

Silver State Helicopter (SSH) school headquartered in Las Vegas closed abruptly by filing Chapter 7 leaving 2,500 students out to the street. They operated over 250 helicopters at over 40 schools nationwide in the US. All students prepaid $70,000 each for their training fees. A Class action suit is pending in the Nevada Court and the lawyers are having field days. Good lawyers can compose an opposing lawyer’s argument before composing his own and they are very good and capable indeed and naturally they command high fees most can’t afford.

The only chance of recovery of the student’s fees from ASA is by naming KFA along with banks and lending institutions as co-defendant on the premise that they too are culpable for the damages sustained by those entrusting students. Their failure to perform proper audit and due diligence on the flight school led to the demise of the program today otherwise succeeded. This premise has a much greater chance of succeeding and the judgement amount of $5 mil range plus legal expenses has far more chances of collection from KFA and the Indian lending institutions involved than nonexistent collection probability from the duo Prince and Reny.

Now sit tight and think hard about the good advices offered in the Capt. Kishore’s post and begin to make a check list of your own action plan and proceed to follow thru on it one by one. BTW, make sure to insist on a kind of insurance policy like the one mentioned in the navdeev’s post if you’re fortunate enough to take out another loan again.

Before too long, you’ll be out of the soup and turbulence and you’ll be back cruising in the smooth blue skies again. How do I know this? Well I went through the similar ordeals few times myself since my first arrival in the US in 1968 from Asia and got my ATP, A&P, MEI, AD and few more ratings and pursued my aviation career until my semi-retirement from flight duties few years ago. Well, that’s my two cents. Hang tight and never ever give up your goal.

At least we do not deserve to be stoned all the way. Our main goal was the quality of training, we may have made our mistakes along the way, but we are also humans with a limited capacity… and ASA was a business, a successful business for 6 years in a row. but if the US and countries governments still can’t solve the fuel problems, why did people think we can? Consider this, Six months ago, we went to all the students saying you have to pay an additional $6,000 to $8,000 more for your training, what would have been the response? i personally went to UAE, China to get more profitable business so your families does not have to come up with the additional funds.

I am surprised, that Sasha Puri, Vikram Pawar, Suraj Chopra and Ameya Kameth did not mention to any one, that they paid their tuition in Gurgaon and that ASA in California never got a penny out of it?!! Specially that 3 of them already graduated, now was ASA out to Scam student? How about each one who paid the $2,000 deposit in Gurgaon? And the US never got a penny of it, but all of you got the credit on your account?

Now every one is going after the management, fine, put your self in Prince’s shoes and he admits he is an AW!!

On New Year’s Day, Juana opens up the school and is feeding the fish in the tank; guess what she found in there?

On a weekend evening, a drunken student pulls the fire alarm (Accidently!!) who had to leave the house to baby sit the reset of the students?

Students playing cricket in the parking lot, using the school’s furniture as goals..
For God Sake, we had to teach students to take a shower before showing up for class!!

Add to that, dealing with the FAA, Mechanics, India, lawyers, accountants, airport management for every little thing that students do!!

Parents, how do I tell a father, that your son is drinking every night and I have an arrest warrant for him? How do I tell your parents, your son is not showing up for lessons because the schedule is too early?! How do we tell them, your son is too busy with the bank teller and does not have time to study?!! Etc…

Here is what happened,
April last year 2007, Gurgaon was shut down costing a lot of money
July, was the last KFA interview
November, KFA staff came to visit to expand the relationship, instead, students complained about the housing and God knows what else, so they did not give a damn and cancelled the tie up!!
Still in November, 17 Students panicked and left the school creating more negative publicity.

Here is a quick lesson in business, if your current customers are pushing your new customers away for whatever reason, you run out of money and eventually your business runs out!!

ASA lost the market in India, even though, over 200 students graduated form there, all of the sudden, every one forgot that fact!!
November, I go to UAE to get some business, I got one student
March I got to China to get some business, it takes time
April I go to Egypt to get some business, we got 3 .

All of that and the FAA is on our tail to shut us down, in 2007, we had 109 inspections, and my question to them, if we were so bad, why did not you shut us down?!! And if we were not so bad, why did you inspect us 109 times?
I still do not have an answer to that, the FAA alone, costed 20% of Prince’s work week just to entertain them!! Why is it, that none of the students asked them that question?

I am sorry the management had to be strict as we did not have time to baby sit adults who were suppose to be in the air lines in a matter of months, I hope your future captains will make sure to tuck you in your seat before you fly!! Our main goal was to make you a pilot because we truly believed that one day thought out your career, the only thing that will save your life is your training, and that was our priority number 1.

They took our airplanes, cars and our house is about to be taken, but no one can take this from us
Our safety record is 100%, 98% of our graduates are successfully employed and satisfied with the training.

Offers of help are coming from India West Newspaper, California Airways — A flight School in Hayward and many individuals who revealed many shocking things about the owner Manpreet ‘Prince’ Singh who believed to be an illegal in USA and applied for the Political Asylum in 1996 fearing porsecution in India. Bhakti & Bhavna Naik had some more things to be revealed so they came out with an interesting piece of information and wanted us to pulish it. So here it is……..

My name is Bhakti Naik. I and my sister Bhavana paid $17,00/- to the American School Of Aviation in March ,08. In just four days I asked for refund because I came to know that the school has only 6 – 8 planes, has no enough instructors and plus the students don’t get to fly much. I asked for my refund in just 4 days after I got enrolled and since then till date I did not received my refund due. I thought of going to the small claims court, but there the announcer told me that Manpreet Singh already has 4 – 5 cases pending in the court. I talked to one student name Shailender Kapoor and he told me that he got the judgment but did not get the money back. I thought over it and then decided not to go to small claim court as Iwill also sail inthe same boat as the other 4 – 5 students. I have emails from ASA promising me to refund my money back, but still they have not done that. I came to know in March 08 that Prince is a CROOK , since then I and my family started writting to all the authorities for help, which includes the FAA, Sheriffs Department, the Merced Police, The Congress Men’s office, Merced County, Atwater County, and the Assembly Member’s office and so on. Since March 08, we have been struggling hard to fix this crook. At the end March 08, I and my sister talked to the Merced Sun Star’s reporter and told him about all this. Even he started investigating. We have been trying hard and with the help of my familyand by the grace of God , now the whole world has come to know about ASA and Mr. Singh and his so called wife Reny Kozman. Since March , we used to visit the students of ASA and asked their help and tried to save them from this Crook but at that time no one supported us. But still we didn’t get afraid or never back up and kept fighting against Singh and now we are happy that its worth all our efforts !
Thanks to FAA and the county for their help.
We are also thankful to Scott Jason of Merced Sun Star for helping us and for publishing the news regarding Singh and his school which alerted the students of ASA. Out of 100 there are still some students who are the stooges of Singh and I am afraid that they are future Singh and Reny.
But because of gods blessing now the whole world has come to know about these crooks. We have heard that Manpreet Singh is staying illegally in this Country, he had come to US in 1995 on a student visa and ended up staying here. We are still working hard and will keep working hard till we see Singh and Reny behind the Bars.

I am Bhavana Naik. On 26th June, 08 there was an open meeting at the Barracks of American school of aviation , and so me and my sister who had paid $17,000/- to ASA had gone to attained the meeting. Singh was talking to the students that FAA had called him and asking him “sir when and where are you opening your next school,so that we can issue the license”…..this is all fake. He is trying to fool the students. Because FAA does not talk to anyone on phone and they don’t keep calling anyone. Later he said to the students that “who told you that my planes are grounded,stop spreading out rumors.”………what does this Singh think that whatever the media says is all fake and if the planes are not grounded then why is school closed?……I asked Singh. “where is my $17,000/-, give me the accounts”?. on this he said “*#***#**”…….and later he asked his stooges (students) to push us and assault us and throw us out of the meeting. the students pushed us physically and used bad language with us. Later we called the Sherriff and lodged a complaint against Singh, his wife Reny and the students who assaulted us physically.
I just want the world to know that how this Singh is and plus about the students, because the world feels sad for the students but yet there are some idiots who don’t deserve a pity but they deserve a good punishment for being the stooges of Mr.Singh.
I need help whether how can we FIX , Mr.Singh. He is now trying to open another Aviation school in Sacramento, we are trying our level best to stop that. Please suggest me as how can he go behind bars. If anyone knows more about him please come forward so that we can save the world from such CROOKS.
